- Engaging in any illegal or fraudulent activity.
- Infringing upon the intellectual property rights of others.
- Posting or transmitting content that is defamatory, obscene, or offensive.
4. Platform Responsibilities
The Scout Global uses advanced technology, including AI, to process and analyze data. While we strive for accuracy and integrity, we cannot guarantee absolute accuracy and completeness. Users acknowledge that reliance on platform information is at their own risk. The Scout Global is not liable for any errors, omissions, or inaccuracies.
5. Intellectual Property
All intellectual property rights in the platform and its content are owned by The Scout Global. Users may not reproduce, distribute, or modify any part of the platform without prior written consent.
6. User Content
Users retain ownership of content submitted to the platform. By submitting content, you grant The Scout Global a nonexclusive, worldwide, royalty free license to use, reproduce, and distribute the content. If you upload images or videos of another person, you confirm you have obtained their consent.
7. Termination
The Scout Global reserves the right to terminate your account at any time for any reason, including breaches of these terms.
8. Limitation of Liability
The Scout Global is not liable for any indirect, incidental, or consequential damages arising from the use of the platform.
9. Indemnification
You agree to indemnify and hold harmless The Scout Global from any claims or damages arising from your use of the platform.

- Make up to two backup copies of the app and documentation.

Terms and Conditions for Businesses on The Scout Global
1. Acceptance of Terms
By using The Scout Global platform, you agree to comply with these Terms and Conditions. If you do not accept these terms, discontinue use of the platform immediately. The Scout Global reserves the right to update or modify these terms at any time, with changes becoming effective upon posting.
2. User Conduct
2.1 Prohibited Activities
Users must refrain from engaging in any of the following activities on The Scout Global platform:
- Posting or transmitting content that is harmful, abusive, defamatory, or discriminatory.
- Uploading content that contains viruses, malware, or any other harmful software.
- Misleading other users by providing false information about your business, products, or services.
- Engaging in activities that disrupt or interfere with the platform’s functionality or user experience.
2.2 Content Moderation
The Scout Global reserves the right to monitor user content and take action against any content that violates these Terms and Conditions. Actions may include content removal, issuing warnings, or account suspension.
2.3 Reporting Mechanism
Users can report violations or misconduct through the platform’s reporting tool or by contacting support directly at talent@thescout.app. The Scout Global will review reports and take appropriate action within a reasonable timeframe.
3. Platform Responsibilities
The Scout Global acts as a platform connecting businesses with potential customers. While we strive to ensure a seamless experience, we do not guarantee specific outcomes such as sales or leads. The platform is used at your own risk.
4. Intellectual Property
You retain ownership of your business’s intellectual property. By using the platform, you grant The Scout Global a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute information about your business for promotional purposes. Users are prohibited from infringing on The Scout Global’s trademarks and branding.
5. User Content
Users are responsible for the content they post on the platform and must ensure it is accurate, truthful, and lawful. The Scout Global disclaims responsibility for user-generated content, which does not reflect our views.
6. Payment and Fees
6.1 Service Fees
The Scout Global charges service fees for access to certain features and services on the platform. These fees may vary depending on the type of service, subscription level, or promotional offers. All fees are non-refundable unless stated otherwise.
6.2 Payment Methods
Payments can be made through various methods, including credit/debit cards, mobile money, bank transfers, or other payment systems approved by The Scout Global. Users are responsible for ensuring their payment information is accurate and up to date.
6.3 Billing and Invoicing
Businesses will be billed according to the pricing structure communicated at the time of subscription or service selection. Invoices will be issued electronically, and payments must be made within the specified period to avoid service interruptions.
6.4 Late Payments
Failure to make payments on time may result in suspension or termination of access to paid features. The Scout Global reserves the right to charge interest on overdue amounts at a rate consistent with Kenyan law.
6.5 Refund Policy
Refunds may be issued at the discretion of The Scout Global under specific circumstances, such as billing errors or service disruptions. Refund requests must be submitted within 30 days of the transaction date, and approved refunds will be processed within 14 days.
6.6 Dispute Resolution
Any disputes regarding fees must be raised within 30 days of the billing date. The Scout Global will review disputes on a case-by-case basis and provide a resolution within 14 days.
6.7 Fee Changes
The Scout Global reserves the right to modify its fee structure at any time. Users will be notified of any changes at least 30 days before the new fees take effect. Continued use of the platform after the fee change constitutes acceptance of the new rates.
7. Termination
7.1 Grounds for Termination
Accounts may be terminated for reasons including, but not limited to:
- Violation of the User Conduct guidelines.
- Failure to pay service fees or resolve payment issues within the specified timeframe.
- Engaging in fraudulent activities or illegal conduct.
7.2 Appeal Process
Users may appeal termination decisions by submitting a request to The Scout Global within 14 days of account termination. Appeals will be reviewed on a case-by-case basis, and a final decision will be communicated within 30 days.
7.3 Effects of Termination
Upon termination, users will lose access to their accounts and all associated data. Any ongoing transactions or interactions on the platform will be automatically canceled. The Scout Global may retain user data in accordance with its data retention policy.
8. Limitation of Liability
The Scout Global is not liable for indirect, incidental, or consequential damages arising from the use of the platform, including but not limited to loss of profits, data, or business opportunities.
9. Indemnification
Users agree to indemnify and hold harmless The Scout Global and its affiliates from any claims, damages, or expenses arising from their use of the platform or violation of these Terms and Conditions.
10. Data Privacy
10.1 Data Security
The Scout Global employs industry-standard security measures, including encryption, firewalls, and access controls, to protect user data from unauthorized access, loss, or misuse. Users are responsible for maintaining the confidentiality of their account credentials.
10.2 Data Retention
User data will be retained for as long as necessary to fulfill the purposes for which it was collected or as required by law. Users may request data deletion upon account termination, and The Scout Global will process such requests in accordance with applicable regulations.
11. Dispute Resolution
11.1 Process Overview
Any disputes arising from these Terms and Conditions or the use of The Scout Global platform shall be first addressed through good-faith negotiations between the parties involved. If a resolution cannot be reached, the dispute will proceed to mediation.
11.2 Mediation and Arbitration
If mediation fails, disputes will be resolved through arbitration conducted in Nairobi, Kenya, in accordance with the Kenyan Arbitration Act. The decision of the arbitrator shall be final and binding on both parties.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any legal proceedings arising out of or in connection with these terms shall be brought exclusively in the courts of Nairobi, Kenya.
13. Changes to Terms
The Scout Global may update these Terms and Conditions periodically. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.
